Professional Experience:Mr. Dahan focuses his practice on commercial transactions and litigation. He represents all types of businesses, franchisors and franchisees in various industries. His expertise includes negotiating, drafting and revising various types of agreements, including, but not limited to, sale and purchase agreements, commercial leases, supply contracts, manufacturing, outsourcing, and intellectual property licenses. Mr. Dahan's litigation experience provides him with valuable insight as to legal issues that can be avoided at the time contracts are drafted and negotiated.
Mr. Dahan also represents franchisors, franchisees and other companies in a variety of transactions and litigation relating to franchising, distribution and licensing. These matters include breaches of contract, business disputes, commercial lease disputes, drafting and negotiating franchise agreements, breaches of franchise agreements, franchise terminations, transfers, renewals, representations in franchise disclosure documents, unfair competition, trademark, violation of noncompetition and nonsolicitation agreements, real estate construction and financing disputes, as well as a number of other issues arising in the course of relationships involving franchisors, franchisees, distributors, dealers and other businesses.
A significant part of Mr. Dahan's practice is also devoted to the representation of condominium and community associations, assisting clients throughout both the developmental and operational stages, and with day-to-day business, legal and management issues, transition, construction issues, vendor contracts and disputes, and any necessary litigation. He provides a full range of legal advice and services involving drafting, negotiating and interpreting all governing documents, association service contracts, rules and regulations, resolutions, policies, elections, collections, developer transition, construction defect litigation, municipal services and relations, regulatory compliance, insurance claims, member relations and disputes, restrictive covenant interpretation and enforcement, and fiduciary duties of board members.
With respect to construction litigation, Mr. Dahan represents owners and community associations in an array of construction defects and claims. He represents parties in claims including design and construction defects at the time of initial construction. Moreover, he represents parties involving claims that arise in the course of vendors providing maintenance or repairs. Mr. Dahan has successfully represented community associations in recovering millions of dollars related to improper installation and maintenance of fire sprinkler systems. He has also successfully represented an owner in connection with improper installation of pilings to support a vacation home mostly in water.
In 2008, he was selected by the business publication NJBIZ to receive their "Forty Under 40" award. The award recognizes dynamic business leaders under the age of 40 who have been making headlines in their field, and who demonstrate a strong commitment to business growth, professional excellence and the community.
