Transfer of Development Rights

Created and Implemented New Jersey's First TDR Program

Our attorneys represented Chesterfield Township (Burlington County) in creating and implementing New Jersey’s first and highly successful TDR program under the Burlington County Transfer of Development Rights Demonstration Act of 1989, which resulted in the permanent preservation of thousands of acres of the State’s most valuable and productive farmland. The success of Chesterfield’s program eventually led the legislature to adopt the State Transfer of Development Rights Act in 2004 to preserve valuable agricultural lands outside of Burlington County. We have also successfully represented municipalities in sustaining their large lot zoning initiatives and in upholding areas in need of redevelopment and/or rehabilitation designations under the Local Redevelopment and Housing Law (LRHL).
