Settlement of claims under the Individuals with Disabilities Education Act could have far-reaching ramifications

This term, the Supreme Court will hear a case that could have a far-reaching impact on the settlement of claims under the Individuals with Disabilities Education Act or IDEA. Settlement is encouraged under IDEA, which makes available a free appropriate public education to eligible children with disabilities. IDEA is unique in that even adversaries in litigation have the same ultimate goal – providing students with an appropriate education - which makes settlement an important part of this legislative scheme.
